Let me ask you the opposite question : How does NOT passing CIR help us ?
I bet you don't have a convincing answer for that. Therefroe, it follows that CIR (even if it is not ideal) will be better than no bill being passed.
And all those anti-CIR folks please get this : It does NOT give instant citizenship to anyone, nor does it put these folks ahead of us in the line. The core team had repeated this several times when CIR was under discussion. That is particularly true for us .. those who who are against illegal aliens are also against high skilled legals with a few honorable exceptions like Cornyn and Kyl. If that wasnt the case, the house and the senate would have passed SKIL in a jiffy by now. Its best for us to remain neutral on the illegal alien issue .. and back it to the extent that it benefits us through a piggy back ride.
Actually I do have a convincing answer... whether or not that bill passes, we are in a lose-lose situation. I have read the bill (not in its entirety like I already stated). I know that the amnesty section already specified there will be no immediate granting of citizenship, excepting the wording for those who have been in this country for more than 5/6 years seems to imply they would get citizenship (again, the way a bill is worded can be twisted in future).
What I am worried about is, I get the feeling this is going to end up dipping into our EB3 pool... we previously had a Sched A for physicians and nurses that took numbers out of EB3 exclusively for them.
And I don't listen to Lou Dobbs or NumbersUSA rantings. But if you kept your ears open more than 6 months ago, you would also have heard some Dems says some not-so-friendly things about us.
One prominent Dem senator said H1-Bs are not suffering as much as illegals.
Another prominent Dem said this country needed more farm workers, not more IT / skilled ppl.

I agree its a great idea, still most of crowd don't understand what are we asking and relates us to un-documented workers.
Even within legal community most people who are pre-gc stage (H1/LE Etc) they don't have any interest; ppl came to me at work after rally to tell me that they are 4-5 years away from my situation so they didn't feel attending rally. Bigger the better, we need big crowd, NJ/NY/MD/DC/VA are worthless. We can try doing rally in Houston, TX area, we may find dedicated people there. But I feel it will be very tough to show heads rally in big numbers.

This discussion is very valuble for people like me deciding between living in Canada as PR vs H1B USA .We all know that salaries in USA are slightly better than Canada .But now the exchange rate is almost equal.
Salary:
Can a person with family(2 kids) survive in Canada with CAD 50,000 / year salary in a place like Toronto.? I heard in Canada you pay 13 % tax on anything you buy .Does 50 % of your income goes in taxes ?
HealthCare:
Also is the government sponsored health care good compared to USA .I mean do you have any wait to see specialists.Is healthcare comparable to USA.
Immigration:
In USA anyone can get a Greencard regardless of their qualifications and it depends how early you enter the GC queue.But looks like in Canada they value your educations and other qualifications.Can IT professionals (non-managers) apply for Canada PR without a job or Canadian education?
Canadian Citizenship:
Many people want to get Canadian citizenship and return to USA with TN Visa .In future ,could USA put restrictions on this .?

an Indian family friend of mine here in U of T, his wife happens to be born outside
India. I always advice them to keep an eye on opportunities in US, GC is worth the hassle for him.
With 2 kids you get tax benefits from Govt. Yes its hard. But its even harder and risky with
H1B in US. Taxes are high and so I am now planning to work as sole proprietorship
, something that I am not allowed to do in US.
Socialist Health care can never be equal to privatized health care in US.
In Canada you pay in terms of wait times (but not as bad as the private insurance lobby is portraying in US nowadays)
But if it is non emergency and needs long waiting I can get that done in India as well.
Skilled immigration is closed for non IT managers now.
Actually US has lately liberalized the TN1 visa for Canadians. It used to be 1 year but lately increased to 3 years. As H1Bs are squeezed out of US, the demand for non H1B needing people will increase and that can benefit TN1 visa holders.

I gave all my signed I485/G28/I325/I765/I131/693/Photos forms by June 8th. They filed mine on June 27th. They reviewed it for 17 days.
They never attend email or calls. Hope mine gets accepted.
I sent my documents to them on June 10th and due to my persistent push they mailed on June 19th . But general responses are more than decent.

None has called a ban for anyone being differ but it's just the way you express your opinions by using the words like "herd mentality", "dimwitted" etc. Not that you have accepted that you are here for news only, I don't think we need people like you.
IV is not a news site. It's a group of people who are fighting for a common cause. One needs to understand the common cause is not just helping July filers or people affected with retrogress but a bigger aim of helping all the legal employment-based immigrants. But one also needs to understand that not all the objective can be accomplished at a time and we need to strike the iron when it's hot and make every opportunity count, be it a BEC, retrogression, July filer or Visa recapturing.
Having said that, I do agree that BEC is one of the issue which should definitely be focussing on next. I'm sure IV members (even if they are not a BEC victim) will support whole heartedly any cause which can bring some relief to BEC victms. What we need is a united front and some unique ideas like flower campaign. Do not forget the flower campaign idea was pursued by one of the IV member who was not part of core.
I think critics of both sides of the argument need to have their say but in a decent manner. This is a public forum and while personal opinions are welcome please be sensitive to the situation other people are in before making any statements. Everybody needs a place to vent out but this is not an forum for vents, it is for a common cause. While we acheive some small victories in this long wait the actual battle is ahead of us and lets not lose focus. There might be many of our fellow members who might become inactive because they recd their GC's or simply not interested anymore and yet at the same time there would be many more new members joining the group for help and advise.
It is imperative to understand , as often pointed out by logiclife, that one person's loss is not anothers gain here. While some of us may feel bad because even latest PERM approved can file 485 while BEC stuck filers are waiting in the benches there is no guarantee that they will get GC before us. If that were true then there would be not so many people waiting here for their GC's. I do feel worried to an extent about how this might affect my chances of getting a GC(waiting 7 yrs already, 485 filed 3 yrs ago) but is there anything we can do to change this? -certainly, the way to change it is to look at the big picture and try to eliminate the reasons for the backlog issue and see that reduced. If that is done and we see some changes on account of the SKILL bill or any of the other initiatives like re-capture of old unused visas or one Visa number per family then all of us would be in a better situation.
For those people who are insensitive to the emotions of people who are stuck in BEC remember till yesterday you were also cursing USCIS(irrespective of your PD) about not being able to file 485 and yet today you scorn those who feel wronged for not being able to file because of this BEC mess.
Lets all unite and try to work towards the large picture issues rather than squabbling over things like this. TO BAN or Not to BAN is IV moderators perogative, if somebody violated the spirit they need to get a warning and given a chance to change or then banned..my thoughts..

I got a relief. So since I ma on EAD and on I-485 status is it ok to take a break for 3 months and then start the next job. So this break will not affect my status right.

Unfortunately i doubt that anyone wud raise it in the senate. As it is the H1Bs are facing issues, can u imagine the uproar NumbersUSA wud create on hearing this. There are a LOT of things wrong with the US immigration system.

I really can understand how you and the thousands like you feel. Let me however point out something. All those who got to file the 485 now have just put their name in the que. When you join the que by filing 485 you will move much ahead of most. Having said this, I still feel that this is not a proper way that USCiS should be handling cases and we should send a strong message that when there are cases to be dealt with they shouldn't be ignored and over run. I am not affected by this situation and am neither a beneficiary of this July bulletin, but very very strongly support your point. Please consult with IV leaders and get their opinion on this issue. They have been fighting for all our issues and I am sure they will have a plan of action to deal with this too. Wishing you all the best and hoping all our members support you. ONLY A CRYING BABY GETS MILK. thats how this world works.

Here the fiscal Year is from 1st October to 30th September. If this bill is done within next couple of months, we are talking about 1st October 2007. This is my interpretation.
Section 502 (Merit based system) is effective from first day of next fiscal year after this bill is enacted, provided it is ateast 270 days away. So I am guessing, we would not see Merit based point system till 1st October 2008.

I probablly know the answer to my own question, but would like to know other opinions. My lawyere tells me this. Since the dates were current when I filed for my I485 in July, the application will be processed regardless of what the dates are right now. Another words, he thinks that even though the dates are showing as 2002, my application will be processed since when we filed, they were current.

I do not have paystubs from company B and C. If I have to reenter US, will that be a problem? Please help me out.
If you have to get visa stamping outside US then you only need to show paystubs for current employer. The CO will check if you have been in status throughout your stay in US and might ask you why you change employers so many times.
