If my attorney is to be believed, USCIS will clarify on Wednesday regarding whether/how to file without receipt notice.
BTW turns out I'm with Nebraska SC too. I had just assumed I would be in TX given that I live in TX! :D

I also do not understand why H4 are not eligible for work permit. I think when they passed H1b, they did not lobby for H4's to have work permit as they probably did when they introduced L1/L2 and E1/E2 visas. The onus is on us H1b holders to ask for H4's to have work permit. So I hope IV adds this to their list of goals if it is not already one. Lot of people understand that current H1b limit is not enough so this could be a good option if they are reluctant to increase the H1b cap.

I heard Nancy say she would get started with some legislation that both parties and president agrees and she mentioned CIR. To pbojja, if you think being concerned about fraud desi companies and highlighting issues we can resolve easily (like English classes) is being disrespectful to one's fellow country men/women, then I must not have put forward my point clearly and I apologize for that. I never said that only English speaking skills were required to be a good professional. However, they are important tools for effective communication. Not every desi IT professional in the U.S. is a developer and is in roles which do require good English speaking skills. Anyway, I didn't mean to be disrespectful to anyone.

My lawyer asked me $400 / form as his fees so $1600 lawyer fees to apply for Spouse and mine EAD , AP. Plus $1300 USCIS fees. All this to fill a one page no brainer form. I decided to file it myself but I am sure there are lots of people who will pay them for that and why would they want 2 years EAD when they can make money every year for so little effort.
In this big black hole we are alone, not the govt. nor the lawyers really care for what goes with us. USCIS is just a money making machine for the govt. Rules are made complex and there are several layers of forms. I wonder why a person should go thru 2 stages before filing for I-485. Or why they have 5 different forms filled Labor/I-140/I-485/I-760/I-131 blah blah blah when they could just do it with 1 form like any other country have or may be 2 layers, labor and I-1485. There's no logic of having to file I-140/I-760/I-131. It's all money game...

If you are using HP laptop...and if you didnt restart for couple of days, there is a problem. The cursor will keep jump and you end up like this.

Fragomen employees are told they represent the company. The company is their client. They are a corporate law firm. There are instances when the law firm represents you, the foreign national. Usually this is when you are applying via a marriage based case, or are in the final green card process and it has reached portability. There is information that law firms cannot release to you as some information requested belongs to the client, and they must receive authorization from the client. Yes, I used to work for Fragomen, before anyone wants to assume anything. I was a paralegal and worked hard for every case that was given into my hands. I specialized in the green card process and made sure I responded to every foreign national as quickly as I can. Please understand that paralegals and legal assistants are subject to the attorneys they work for. Therefore, some questions you may ask require an attorney to respond, and the paralegal or legal assistant's delay may be in trying to get the answer you require. I know not all Fragomen offices work the same. Not all will respond to you in the same manner. Some may be worse than others. So if you are going to defame Fragomen, would you please try to specify which office you are referring to?

To those of you who have had negative experiences, I am sorry that your case went to someone who only looked at their work as a job. And for the person who had asked about the prevailing wage, it comes from the state employment department, not the federal government. Some offices work faster than others. When a prevailing wage comes back higher than what you are making, the law firm then has to go back to the employer to find a resolution, which can mean either an increase in the salary once you have received the green card, or confirmation that is what you will be making at that time, or a reduction in the requirements, which can sometimes take a case from EB2 to the EB3 visa category.

Not from last nights interview, but in primaries season during Politico's live interview on CNN Obama said this about legal immigration:
"It is important that we fix the legal immigration system, because right now we've got a backlog that means years for people to apply legally. What's worse is, we keep on increasing the fees, so that if you've got a hard working immigrant family, they've got to hire a lawyer; they've got to pay thousands of dollars in fees. They just can't afford it. It's discriminatory against people who have good character, but don't have the money. We've got to fix that. "
I know that's what he said but if you read that statement again, nowhere he talks about Highly skilled legal immigration. I think he is talking about the family based immigration, which again caters mostly to the Vote bank. From everything I have read, Obama seems to be anti-outsourcing and neutral (or maybe negative) towards highly skilled legal immigration

My understanding is they wait until last quarter to give the spill over. But this time they started giving the numbers in 3rd quarter itself. Keep in mind EB1 is current and Eb2 except I and C is still current.
I expect to see at least 20k visa's issued to EB2 I and C.
EB2 China wont take much visas because EB2 china PD cut off date was already Jan 2006 a year back. So it takes its reguler 9,800 visas for this 2008 fiscal year.

Just called. She first said that she will put me on as a supporter. But since I am not from his district, they are collecting all those names in a separate pool.
