Hi,
As July visa bulletin indicate/predicted that for EB2-I it might reach up to March or April 2006 in FY2010.
Is FY2010 is Jan to Dec 2010 or FY2010 ends at Sep 2010 for USCIS? My PD is Mar2006 Do I have to wait till Sep/OCT 2010 or till end of 2010 i.e. Dec?
What is USCIS's Fiscal Calendar / Jan to Dec or Sep to Oct?
I'm planning to go back to India so just wants to see, should I wait for 3-4 month more or it's going to be end of this year?
Thanks a ton,
RW

I flew Air France once in 2003. My connecting flight from Paris to Delhi got delayed by 12 hours. When I approached the Air France staff, they told me that since I had an Indian passport, I would have to wait out the entire time in the transit area. Meanwhile, they proceeded to make arrangements for other non-Indian passengers. They even refused to acknowledge my attempts to reason with them, either not replying to me, or replying only in French. I filed a formal complaint afterwards, but never got a reply.
I have travelled on numerous times since then, but never with Air France. I don't even consider them as an option anymore.
I had a similar experience in 2004 when I took Air France for the first time (to Delhi, connecting at Paris). It was the last time I ever took Air France.

Dear all,
Please assist IV in this important initiative to bring DC's attention to our issues such as processing delays and delays due to retrogression. Who knows what will happen in future about immigration.. I just read that the senate is planning to come up with a commission that will control the legal immigrant limits...
washingtonpost.com (http://www.washingtonpost.com/wp-dyn/content/article/2010/05/23/AR2010052304034.html)
It is all the more important to meet and let the senators know what we are going through so that they may think properly for the future.
I have already contributed a humble $50 for this advocacy initiative and will contribute again in first week of June. Please do your part in helping IV and in turn, yourselves.
Regards,
av2004

I didn't attended because recently I had a new boss and he was monitoring my daily schedule and being in H1b and coming so close to filing I-485, I was just waiting for my EAD or I-485 cheques to get encashed. On 21st Sep, they got encashed. Now I am bold enough to take a day or two as vacation and attend rally if organized in eastern part.
I did paid 50% travel cost to one of our member from CA.
Sorry for not attending this time, will do it next time.
hello all, could not attend due to work schedule and a baby due any minute!! but am contibuting monthly and sponsored a student from houston. way to go iv amazing effort!!!
I was 100% determined in the beginning to attend the rally, but could not for the following reasons.
1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.
2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.
Of course we contributed towards the rally.
I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.
Also we are eager to join in the next rally and have total faith in IV leadership
IN WHATEVER YOU DO DO IT WITH YOUR HEART - FOLLOW YOUR HEART
ANYTHING THAT IS DONE FROM THE HEART WILL PRODUCE RESULTS.
ONE MEMBER I KNOW FROM NY CHAPTER IS IN PATHETIC SITUATION - JUST GOT LAYED OFF, HIS COMPANY REVOKED HIS i 140 AND HE IS BACK TO SQUARE 1 ON GC PROCESS AFTER 5 YEARS, HE HAS BEEN LOOKING FOR JOBS ON A WAR FOOTING BASIS AND AT THE SAME TIME CAME TO ALL NY CHAPTER MEETINGS AND DISTRIBUTED FLYERS, ALSO HOPPED ONTO THE BUS AND ATTENDED THE RALLY. HE IS A REAL HERO AND I AM SURE SOMETHING EXCELLENT WILL HAPPEN TO HIM
NONE OF THE EXCUSES HERE SEEM GENUINE EXCEPT THOSE IN WEST COAST WHERE IT IS DIFFICULT TO TRAVEL
Above excuses seem perfectly genuine to me. I had a court hearing myself. I applaud your friend's sincerity in attending the rally and I also applaud everyone who attended for that matter. But, IMHO, you were too quick to judge/question other people's genuineness.

If you think there's only dimiwitted folks here, need I remind you that you are posting here too.
Anyways, mistakes are made and can be corrected. Name calling doesn't achieve anything.
Shows you the general herd mentality on this forum. As long as everyone is thinking the same way, everything is great. If you differ, everyone will call for a ban on you. They are all lemmings. Unfortunately, I had to come to this forum for news. I have never seen such a bunch of dimwitted people in one place...

USCIS promptly waited for everyone to submit AP & EAD application to move the dates forward!!!
But anyways, the movement is good, let's just see how many get their green cards and for the people who miss this boat as well we need to see how much they retrogress in October!

I had a 2004 PD Labor RIR and my 2006 I-140 used that labor date, because I merely mentioned to an IO at TSC that I had a previously filed labor. My lawyer was shocked when it happened...had never seen it.
So, I wonder if they used your 2004 RIR as your PD. Even then EB 2 is supposed to be unavailable. Oh well, it might help to speak to an IO to get your I-140 PD changed...maybe...

Congratulations to all IV members for being able to apply for I-485. This is GREAT news. Please please apply for your I-485 at the earliest. It would be best if your application reaches USCIS in the week of 2nd July. Here is the link to July Visa Bulletin:
http://travel.state.gov/visa/frvi/bulletin/bulletin_3258.html
Remember that you have to be in the country to apply for I-485. We may soon have lawyers information on our website to answer your questions in real time. Not sure till the time we get confirmation from the attorney but IV is working on this and may post this information soon.
This is GREAT development!!!!

Chapter meetups is a positive step. The so called baby step.... If folks RSVP and do not show up, the leaders will get upset if the same folks do not have the courtesy to tell why they did not show up....;)
First off, I don't appreciate your sarcasm @ 2 cents leading to a dollar. Secondly if your leader is going to scream at people who are not attending the meetings, this is only going to drive people away from IV. Unfortunately, as someone who has learnt it the hard way, using aggressive language (especially language which is a negative judgement on people's nature) does not get the work done at the end of the day. Peace out and good luck with your stuff.

People were very happy with the last USCIS announcement but we all forgot about pain of people who are stuck in years of backlog. Though some of those unfortunate may have used harsh or improper language, but they had all the right to express their feelings. We all talk about Gandhian philosophy, but we need to be more tolerant. Before we ask to ban anyone from our forum, please try to put yourself in their shoes.
Our fight is far from over, we should all fight for for in-justice made to people who are trapped in the bureaucracy.
banning people is not the solution to the problem...live and let live...reasonbly

All that is being said is very true. Petitioning the US gov't is as American as apple pie. As aspiring Americans we can only be respected for this, if we do it politely and peacefully.
People who put in a herculean effort (not to be underestimated by anyone here) to organize the rally and surrounding activities, broke their backs trying to lay a platform for the rest of us to communicate our case. It is only natural that when they get the lamest of lame excuses, they feel upset.
Every one of us has skin in this game. We need to find some way to lend our weight to this issue rather than just passing time on this or other websites. It is really unclear to me why in America, the most free society on the face of the earth, people feel unmotivated, inert, insecure etc to press what is a most legitimate grouse.
Let me give you a few points that might convince you in this issue. For most of us:
1) We are here at the behest of our employers or the US Gov't (NIW cases). Not on our own accord or illegitimately.
2) The US gov't has certified that our jobs do not have suitably qualified americans to take them.
3) The US Gov't has approved our immigrant petitions.
4) We are in a period of inordinate delay to complete the steps due to a variety of factors, including bureaucratic delays, inordinately long security checks(BTW bad for both us and the country) and an inadequate supply of visa numbers for the number of approved petitions.
5) We are asking the US Gov't to fix this issue and treat us fairly and not make us wait 6-10 yrs for no clear reason.
6) We are asking them to be more straightforward in their policy and to stop sending mixed signals.
Above all we are doing it in the most American of ways. Peacefully petitioning and lobbying the government. Most broad minded Americans can and do relate to this.

If existing members don't show the commitment to the meetings or whatever we organize, then how can we expect new members to do anything?
I feel weird even saying this, but guys don't you know that it is simple courtesy to let the host know in advance if you can't make it?
And anything more than 15 minutes late is just plain RUDE! Do we have to teach this?

Below is the response I receieved from senetor, not sure if my email was read becuase I don't see any word about legal immigratnts in the response,
-------------------------------------------------------------------------------------
Thank you for taking the time to share your views regarding immigration. I would like to take the opportunity to respond to this important issue.
There are currently over 38 million foreign-born individuals living in the United States, which accounts for nearly 13 percent of the total U.S. population. Nearly one-third of this foreign-born population is estimated to consist of undocumented or illegal residents; a clear indication that our immigration system is broken. While a number of bills have been introduced concerning various elements of immigration reform, the issue has yet to come before the full Senate. I am currently evaluating a number of policy options, and will remain mindful of your thoughts on this subject as we proceed in the 111th Congress.
Again, thank you for taking the time to share your concerns with me regarding this issue. It is an honor and privilege to serve the people of the great State of Florida in the United States Senate. I take great pride in being a native Floridian, and I look forward to the tremendous opportunity to better the lives of all Floridians. I assure you I will work hard to represent our state to the best of my ability in the U.S. Senate. If I can be of any further help to you, please do not hesitate to contact me.

People with EB3-India may not expect any kind of fast movement in near future, unless law changes. It will be in snail phase. It is waste discussion to analyze howmany people filled EB3 LC from India in 2002,2003 etc. Generally EB3 is very high demand catagory from all accross the world. EB3 contains skilled worker catagory including cooks, nurses, and so many many non-professional occupations. All the discusion are focussed on demand by Indian IT folks, by ignoring other spectrum of the demand by other group of peoples. Therfore no matter what; EB3-India will get only 3000 EB3 GC per year (Approxmatly 1500 primary).
1500 LC per year EB3 India is a tiny fraction of the demand by EB3 India. Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
Only when EB3 ROW becomes C can EB3 China, India & mexico see a leap in priority dates. March bulletin 08 pushed EB3 ROW by 2 years. Apr bulletin pushed it by another 6 months to Jul05. If demand for EB3 ROW is still low, then final quarter of this fiscal year (Jul to Sep), priority dates for India EB3 can possibly see a jump forward by 1-2 yrs.

I have been to the indian consulate couple of times and what I have seen so far is that people staying in the US take the consulate officers for granted.
People take the token and start filling up the form in the consulate itself, they will be at the window and will be pasting photograph or filling up the form itself on the counter.
I think the consulate officer should ask people that will you behave the same way at an US consulate??
People become impatient just waiting for 10 minutes as if they entire indian consulate has been waiting for them to show up at the office.
The way we Indians behave boarding a flight in US, the same does not happen in India. The way we behave with the consulate officers at Indian consulate does not happen at the US consulate. Why do not the same people trying filling up the form at the US consulate or try pasting photograph and even run to grab the original when they are at an US consulate.
We want the same level of professional at the Indian consulate then we need to show the same level of professional at Indian consulate that we show at US consulates.
Regards,
Deepak

I thought IRS will allow you to withdraw your 401(K) with a 10% fine + all applicable taxes. Not sure how that will benefit someone who is forced to withdraw becuase he has to return to India.
You go back to India and withdraw one year later when you have 0 US income. Anything below 15K income is not taxable. Your 401 (K) withdrawal is added to your income for taxes
