I didn't attended because recently I had a new boss and he was monitoring my daily schedule and being in H1b and coming so close to filing I-485, I was just waiting for my EAD or I-485 cheques to get encashed. On 21st Sep, they got encashed. Now I am bold enough to take a day or two as vacation and attend rally if organized in eastern part.
I did paid 50% travel cost to one of our member from CA.
Sorry for not attending this time, will do it next time.

I got an email from my law firm, that my packet was refused to be accepted by USCIS.
I received the email from my law firm (Monday night - July 2) that:
Please note however your case was sent to Nebraska last night and did arrive - we tried!
Which means mine was sent or reached NSC sunday night or must have been hand delievered early Mon morning. Don't know exactly what happened. I just trust them!!!!
I didn't bother to ask my law firm further details. I will ping them first thing monday morning and try to give any update I get. I hope they have some proof of the refusal!!!!!!!............

I don't like getting my ass kicked. Hence, I refuse to fly Air India.
Last time I flew that Airline (Boston - Heathrow - Mumbai):
1. The crew disembarked at Heathrow. The transit passengers were not allowed to disembark.
2. The crew shut off the heat/power and opened the Aircraft doors (yes, it was winter).
3. They sent the cleaning staff in to clean/vaccum the plane with a lot of passengers seated.
4. At Mumbai, the airhostess was in some sort of a hurry shoving the passengers so that she could disembark first.
I've never had such experiences with AF. They are not racist. Airlines are not allowed to issue transit visas and anyone who has lived in France can tell you how insensitive and lazy their bureaucracy is.
Bad flying experiences do not equate to racism. It is strong word to use and I do not think it applies to this case. Yes, I have seen French show racism towards Africans, but this is not one such case.
There is a reason why Indians are required to take a transit visa. Coz, in the past there have been Indians (at EU airports) who have claimed that they have lost their memory, do not remember who they are, don't have any ID and hence qualify for asylum on medical grounds. Now these gov'ts are requiring ALL Indians to have a transit visa so that if anyone pulls such antics, they have all the information that they need to identify the individual and deport. Some bad apples have f&^%ed it up for all of us.

And this exact attitude is why we dont respect each other.

The president personally called the PM of singapore and got this person out, who was just an ordinary cirtizen, who actually had broken the law of another country.
So, I will believe whatever the Indian is saying over what the AF guys is saying. period.

My understanding is they wait until last quarter to give the spill over. But this time they started giving the numbers in 3rd quarter itself. Keep in mind EB1 is current and Eb2 except I and C is still current.
I expect to see at least 20k visa's issued to EB2 I and C.
EB2 China wont take much visas because EB2 china PD cut off date was already Jan 2006 a year back. So it takes its reguler 9,800 visas for this 2008 fiscal year.

we were not sure about our priority date in the regular one,and my husband's employer agreed to offer us labor substitution,and so we sent papers for labor substitution to our lawyer whose priority date is now current.But still substituted i-140 is not approved yet.waiting for its approval.Lawyer told us that once substituted i-140 is approved,he would go ahead and file our AOS.
Today the priority date is current in regular one.Don't know how to proceed.Can anyone suggest us here?

If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs. Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.
This is why it is in the best interest of companies to support EB GCs.
My friend Senthil makes the same mistakes (repeatedly, unfortunately):
(A) Assuming that "good" companies will not be affected by any change of increase in fees for H1B, since they presumably have unlimited pockets and unlimited access to unlimited talent. (Big ha!ha!)
(B) "Good" companies can always get to hire people in US if they exist, and the only reason they hire H1 is that they cannot find anyone in US as there is no one in US who is good enough for the job for love or money (Bigger ha!ha!)

Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. Believe it or not, many fraud desi firms have sponsored people in EB-2 successfully. I have worked with many such IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious here, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. I am just tired of fellow country men/women who have diminished our country's image, especially in the IT industry and am trying to think of solutions in addition to what we already have on IV's agenda.
Is english speaking required to qualify for EB2 ? who diminished the country image ? In our company Indians are highly regarded and yes most of us work for desi companies . Dont blame others just becasue your company dont sponsor in EB2.

I believe this might end up needing a class action litigation (for violating AC21 law) and an immigration attorney could make a name for him/herself in the process of this case!
Witness Carl Shusterman's challenge of the USCIS's erroneous interpretation of physician NIW laws and his subsequent stature in the field.
If there are adequate numbers of you, which based on this thread there seem to be quite a few, then approaching a good lawyer to represent the group pro bono and getting this mess sorted out for good might be a consideration.

Members, it will be a big help if we just follow the small steps IV has outlined. Big ideas are great but lets start with the easy things first.
December Visa bulletin is obviously frustrating for all of us. After the recent accomplishments in July visa bulletin and the tons of approvals that we saw after that, we hoped that everything will be alright.
But that did not happen. Some of us in the community were taken by surprise, but this was expected. Afterall there are only 140K greencards available every year. EB2 for India and China is already used up for the quarter. EB3 is badly retrogressed for everyone.
Believe me, it will not get any better. It will get worse with time if there is no immigration reform.
IV can only do what its members empower it to do. If members want us to be just a site for question and answers for individual visa problems we can stay like that. If members want us to come together and do a rally in DC, we will help organize it. We did a rally in DC on Sept 18 and made great progress. However we cannot just sit back and admire one effort. We need to continue it and capitalize on it.
Now is the time for everyone to decide if they want a greencard. If you need a greencard, and want to do something about it, then you must join this effort and help yourself by helping everyone.
Our Plans
Our next hope is year end bills. If we can get some provisions in those bills we can certainly look forward to a happy new year with fast movement of visa dates. 3) Consider yourself part of something big. What we are doing is something big. We have already done what was difficult to think when this organization was started. Today we have become a big force and a voice of legal high skilled community. Each one of you defines what IV is. Each one of you is important for the success of this effort. Each one of us is a voice and we have converged our energies to make a strong voice. December Visa bulletin is obviously frustrating for all of us. After the recent accomplishments in July visa bulletin and the tons of approvals that we saw after that, we hoped that everything will be alright.
But that did not happen. Some of us in the community were taken by surprise, but this was expected. Afterall there are only 140K greencards available every year. EB2 for India and China is already used up for the quarter. EB3 is badly retrogressed for everyone.
Believe me, it will not get any better. It will get worse with time if there is no immigration reform.
IV can only do what its members empower it to do. If members want us to be just a site for question and answers for individual visa problems we can stay like that. If members want us to come together and do a rally in DC, we will help organize it. We did a rally in DC on Sept 18 and made great progress. However we cannot just sit back and admire one effort. We need to continue it and capitalize on it.
Now is the time for everyone to decide if they want a greencard. If you need a greencard, and want to do something about it, then you must join this effort and help yourself by helping everyone.
Our Plans
Our next hope is year end bills. If we can get some provisions in those bills we can certainly look forward to a happy new year with fast movement of visa dates. Thanks for your inputs. Please also read my previous message. If there is a less non-confronting approach that is equally good in bringing this to the attention any authorigy and resolving it amicably we should be all for it.
- So can IV help us by filing a petition/letter to DOL/UCIS or the other relevant authority towards this cause...basically explaining the plight of the affected people and how they have been affected by DOL not doing FIFO processing of the labor applications in the traditional process.
IV core team, please provide us some guidance and please help us here.
- I do agree if the petition doesn't work out then we can think on the law suit. OR we can explore that option and start getting the details of the process parallely so that we have all the information in hand. But if a petition isn't possible (which I doubt) then we should be able to swiftly act on the lawsuit.

2. DID YOU CONSIDER RIR AND REGUALR CASES DIFFERENCES WHEN ARE SUEING FOR FIFO
3. DID YOU FIND PEOPLE FROM THE SAME COMPANY WITH DIFFERENT FILING DATES APPOVED NEW AHEAD OF OLD FILING DATE( THIS WOULD GIVE YOU A STRONG REASONING WHEN YOU WANT TO SUE). COMPANYS PROFILE CAN INFLUENCE A LOT ON DECISION MAKING EX.. MICROSOFT VS DESI COMPANY.
4. HOW MANY CASES YOU HAVE STUDIED FOR VIOLATION FIFO. COLLECT DATA FROM BEC APPROVED PEOPLE AND THE PEOPLE STILL STUCK THERE.
