PBS launched a wonderful new series this evening entitled Faces of America which examines the family history of 12 notable figures in contemporary America. The figures profiled are diverse and include Dr. Mehmet Oz, Meryl Street, Kristi Yamaguchi, Malcolm Gladwell Stephen Colbert and Yo-Yo Ma. I was pleased to see Mike Nichols on the list. Nichols and his family fled Germany for the United States at the age of seven in 1939 just as the horrors of the Nazis were beginning to accelerate. He's always been a favorite of mine from his days as half of a comic duo with...

If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?
Thanks

The last few months have been extremely challenging for H-1B applicants as the Department of Labor iCert program for filing Labor Condition Applications has proven to be deeply flawed. Gone are the days of instant LCA approvals. Now, applications routinely take at least a week to approve and a high percentage of applications are being rejected because of problems with the DOL software. Frequently, applicants need to file an application immediately to remain in status, but USCIS requires an approved Labor Condition Application be included with the application. The USCIS' Ombudsman has weighed in recommending USCIS revisit that policy. Instead,...

YOU CAN. You have two options
You can interfile, the current 485 can be changed to approved 140 (eb3)
or
You can port the approved 140 priority date to the current 140 (eb2).

Hi,
Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.

A lot of people influenced my decision to become an immigration lawyer nearly two decades ago, but one person that certainly deserves mention is Judge Diane Wood. I first took her international trade law class at the University of Chicago and it turned out to be my best grade in law school. I then did an independent study with Professor Wood and wrote about the integration of the European legal profession, a topic that introduced me to the subject of employment immigration law. Five years after I graduated U of C, Professor Wood was appointed by President Clinton to serve...

senate panel on Hold
Who Stalled the Intelligence Bill? (http://www.washingtonpost.com/wp-dyn/content/article/2007/03/07/AR2007030702461.html)
Thursday, March 8, 2007
For what could become the third year in a row, the Senate on Tuesday evening did not pass an Intelligence Authorization Bill, over the objection of a lone Republican senator whose name is being protected by his colleagues.
John D. Rockefeller IV (D-W.Va.), chairman of the Senate Select Committee on Intelligence, called the delay "one of the more embarrassing efforts I have been associated with in my 24 years in this body." The panel's vice chairman, Sen. Christopher S. Bond (R-Mo.), took the Senate floor Tuesday and called on "any person who has a hold on this bill to come forward and find out what is in the bill."
Rockefeller and Bond have been working over several months to meet objections to items in the bill that the committee passed last May. With changes that Rockefeller and Bond worked out, the measure was reintroduced Jan. 27 and put on the unanimous consent calendar on Feb. 8.
Sen. Jim DeMint (R-S.C.), a member of the Foreign Relations Committee, was named by Congressional Quarterly yesterday as the member who put the bill on hold. A DeMint spokesman said the senator's office "does not comment on holds," but other congressional sources said that DeMint was the one.
Those sources said that they believe the hold is due to White House objections to specific provisions, including public disclosure of the national intelligence budget; a requirement for a report on secret CIA prisons; and response to information requests by the committee chairman and vice chairman within 30 days.
"We have to be able to pass authorization bills if we are to have an impact on the intelligence community," Bond said.

will anything be left even to discuss?
Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

Most of the members here think. GC are long pending only because of beneficiary or USCIS only.
This news is also making me to think about the reality of the issues in finding the good company for GC processing.
Let have discussion on this how to find good company for GC processing. Appreciate in advance.

I have a similar question. My EB-3 PD is August 2005 (I-140 was approved but I never filed the I-485 because of retrogression). Few months back I found out that the employer had withdrawn/revoked the I-140. Now my employer is getting ready to file my EB-2 I-140 and my question is: Can we retain/interfile the priority date from 2005? I know the answer is yes but I am looking for examples where any fellow member was able to successfully do so. Thanks!

I already have my 485 pending at NSC. My state comes under TSC jurisdiction.
Where should i file for my EAD, if I don't file concurrently with 485? at NSC where my 485 pending or at TSC?
What are the documents I need to file for EAD?
Thanks for your time.
