Hi
I am in H1B visa (valid until 10/2011), my wife is in F1 student (valid until 8/2011). We just got married 1 month ago in US. currently, we are staying in US. Now, she would like to stop studying for some reasons. To keep her valid stay in US, I have to transfer her f1 to h4. Could you please let me know step by step what I should do, what form I should take…etc.

Does she need any visa interview after filing the transferring f1 to H4?

Can she inform the school that she will stop studying right after filing visa transferring? (the school will stop her f1 if they know that).

People,

I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.

Spouse I-485 Receipt Notice.

Applied I-485 for my wife in the first week of September (8th Sept) when the dates became current, but haven't received the receipt
number yet.

I got an RFE (EVL) on my application which I submitted on 21 Sept. USCIS received the response on 22nd Sept and updated the case.

I am little worried that whether USCIS has received her application or not. Is there a way to find out, whether I can open an Service request or take an Info Pass regarding this?

Any suggestions will be helpful.

If the labor from BEC gets approved and subsequent I140 as well, is it possible to request only the priority date change for the I485?

Not refering to replace the I140. IS IT POSSIBLE TO JUST REQUEST THE PRIORITY DATE?

I live in the Bay Area, California and wanted to travel to Canada for getting my H1 stamping done. Has anybody done the stamping recently in Canada? How was the experience? Also, we were thinking of Mexico initially but changed our minds due to border issues/swine flu fears. Anyone done it through Mexico recently? Please share your experiences.

Its okay to file the 485 at either texas or nebraska. Normally the lawyers file 485 to the same center where your 140 got approved. from.

A friend of mine lost his I797. His lawyer asked him to apply for duplicate.He got the duplicate after few months. I don't know the exact procedure was.

I recall that USCIS was planning to issue 2 year AP and 2 year EAD. I see that the 2 year EAD has been implemented. ANy idea, if and when the 2 year AP implementation is expected?

Hi,
My wife was in US in Oct 2007 on H4 Visa and went back in Mar '08 while she was in US we applied her H1B in 2008 and was approved and she got her H1B stamped in India and came back to US in Oct 2008. since she did not find any job, her payroll is not running and the her employer wants her to switch back to H4 Visa, and once she finds a project she can change her status back to H1B.

My Question here is
1) For COS from H1B to H4, Does she need Pay stubs? and how easy it is for the COS?

2) Her Employer says that she can apply for H4 Stamping and inform the Visa Officer that during her stay in US she did not join the company for medical reasons. Does this create any issues with her H1B.

3) Can Some one suggest a good immigration Lawyer in San Diego?

I got my I-140 Approved (EB3 - Jan 2004) with Company A. Can i use the approval notice and get my H1B extended for 3 years from a different company ? Please advice as this will help me a lot.
