a compromise has been reached between Democrats and Republics for CIR.

hi all,
I've found myself in abit of a predicament. My application for H1B extension is still pending (filed in September) and all I have right now is a Notice of Action from the immigration department.
While waiting, I have been laid off this week... I intend to return back to my home country before my last day (Dec 31).
My question is: Would I be able to make a round trip? That is to say, come back to the US on a tourist visa a week after I got home? I need to come back to sell what I own here and settle other things.
A friend told me that it is better to overstay for however long (maybe an extra week, I don't plan on too long) I need to get my things in order than try to take the chance of coming back. What do you think?
I appreciate any advice you can give.

I think once the I-140 application is filed based on the state of residence, USCIS can transfer it to any service center. The applicant doesnt have any control over it. As far as I know, the applicant cannot request for a change in service center.

Good news. The U.S. Citizenship and Immigration Service (USCIS) recently issued guidance on the new H-1B amendment that limits Troubled Asset Relief Program (TARP) recipients� ability to hire H-1B workers. The USCIS confirmed that the new H-1B amendment does not apply to H-1B extensions for current employees with the same employer.

beneficiary already working for the employer in another work-authorized

This question is to all attorneys for their input on whether there will be another window (or something called pre-filing) for all GC applicants waiting for file their I-485. It would be great if there could be 'pre-filing' with eligibility for EAD since H1 renewals are becoming tougher by the minute.
Attorneys please add your comments if there is a probability of this happening and if not is there any way we can request USCIS to consider?

My company got one previous LC approved whose requirements are BS in CS or Engg related. I have a civil engg degree, I would like to file I140 and get old PD. Will this substitution work? If anyone with "non CS" engg degree used a labor that asked degree in "CS or Engg rel" in item 14 on 750A please share your response.

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.
Here is my current status :
6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?
3. If I was to apply for H1 extension in Nov and don't get an approval by the time of my current H1 expiry in December, will I be out of status?

Those who were able to upgrade to premium processing before Jul 2, did you get a new receipt number for the upgrade? Or was the old receipt number valid?
old one remains valid. Your status on that will indicate that the application has been upgraded to PP, and then the same reciept number will tell you about the decision

The other brand new company is offering me Eb2 with Perm but they don�t have any master degree in the company and also they have a very dummy attorney. I am not joining them until I can file 485 and make sure that I would not lose my PD.
I am form rest of the word category and the Eb2 in current.
Can some one help me with the ad text for Industrial engineer with +6 years of experience. The attorney doesn�t have any clue about Eb2 and specific add in paper. I guess I am going to help her.
