New numbers are out on H-1B usage and the past week showed a substantial pickup in usage with more than 1700 numbers counted against the cap of 65,000. 36,600 H-1Bs have been counted now. I'm moving my exhaustion projection date up about two weeks. My target is based on a rolling four week usage average so variations from week to week are discounted. Usage over the last month has been about 1275 H-1Bs per week. On the masters cap of 20,000, the pace is pretty much the same with 400 petitions counted in the last week and total usage of...

Immigration legislation in Congress ended on a sour note in 2010. The DREAM Act, after narrowly passing in the House of Representatives, failed to get the necessary 60 votes in the Senate required to overcome a threatened GOP filibuster. I was on H1B until Feb 2009 and I applied for COS to H4 in Feb 2009. USCIS has received my COS application, and it is still pending with USCIS for 2 months now.
1. Can a new employer apply for a new cap-exempt H1B for me (technically a transfer, as I was on H1B for 2 years before)?
2. In that case, do I need to submit paystubs and W2s from when I last held H1B status?
Thanks in advance for your comments.
Note: I did not see any posts related to this particular scenario, hence had to create a new thread.

I got my H1-B visa on June 29, 2005 , I came to india on Jan 2009 . From Jan 2009 till now I have been staying in India , bcoz I was taking care of my new born daughter, now she is grown up and now I am planning to start working in US. Right now I got my H4 visa .
I came to know from someone that H1-B filing for this year was over in Jan 2011, so if I need to file a new H1-b , I have to file now and I will be eligible to work after Oct 1 this year. Is it true ? Is it not possible that a company files for a new H1-B under premium processing and I start working after 2 weeks of filing ? I don't want to wait that long(Oct 1) to work , I have few oppurinities coming up where I may get selected.
I have stayed in india from Jan 2009 till APril 2011. Now I am on H4 visa in US. Can I get a extension of my previous H1-B visa filed on June 2005?
I want to work ASAP.

The inventory number does not include the EB1 and EB2ROW filings, which are always C and out of queue/approved in less than 6 months. They are not shown in inventory numbers.

Show that they approve over 60K per year on average (for past 10 years) for EB1 and EB2ROW (EB2 Korea is huge as well)
When we calculate, we should deduct 60K from 140K
The situation is not optimistic

your lawyer. In many cases, the "most recent action by USCIS" counts. So your H1B gets approved and then H4 gets approved, the last action may count. That is why it is important that you consult a good attorney.

I have applied for GC in Aug '07. I recently renewed my H1-B (7th year). I noticed that there is a mistake in the A# of my Green card application (Beneficiary #) on the H1-B approval notice.
Has any one else had this happen? Does any one know what can be done regarding this?

On I140 form, notice type has information about INS section.
The INS section explain that your GC is under EB2 category or EB3 category.

INA Section 203(b) (2) is EB-2
INA Section 203(b) (3) is EB-3

How much time does it take for 485 to get approved with a visa number available. I applied for 485 after my i-140 was approved. Does the priority date have anything to do with processing for 485?

As the title says, can I change from AOS to CP even though my PD is not current.
Will the consulate process my case even if the PD is not current ?
I guess, they should depending on the number of applications at the consulate.
Please let me know whether I should take this route.
Well my PD is Feb 2007 (EB2) so I was thinking of this route rather than wait for endless years in this mess :(

No. OPT means in F1. As long as you register for enough credits, your status continues. The enough credits is determined by your international advisor.
