That's nothing new that Dems are pro amnesty. I am not arguing against that. Nancy Pelosi already said something in that regard I think. What I refute is the argument portrayed by misinformed members that the shift in power was caused significantly by the anti illegal alien position. It is not true. That's all I am saying.
Contrary to belief of some members, I am not disappointed with this. I will continue to be your Ombudsman as usual and report everything, probably you will hear more good news for those who believe that amnesty is the way to go. Facts are facts. I am not here to defend any side.

We should focus on spreading awareness about IV. I can't believe I was totally unaware of IV's existence until a month back. I haven't done much but felt strongly about what IV's doing. Me and my wife attended the rally and even contributed for the first time ever. We should brainstorm on how we can get more people on board and on how to transform members into contributors.

i think this modification of the interpretation of the law is mainly to prevent the massive loss of numbers. I think the DOS now realizes that USCIS cannot effectively handle processing of the massive release of visa numbers in the last quarter, thereby they are doing it in an incremental manner so that the demand is handled effectively (USCIS standards effectively).
I agree; the law definitively leaves no room for error. If all the visas are held back until fourth quarter then there is a significant chance that visas will go unused.
However; it isn't in uscis/dos discretion to make such decisions on a whim for process improvement.
In the orgnizations we work in; there is a big consideration whether the new project or idea is feasible in the current environment. If it isn't then the project/idea gets shelved because it's not doable. However; congress and various regulatory bodies do not give such luxury to uscis. They don't ask them if the implementation of a law or creation of a law will fit into their system or workflow.
At a high level; country quotas in EB do not make a whole lot of sense. I have tried to figure out why they are there; how companies and candidates use EB greencards. Conclusion, I came up with is that in a lot of ways EB is a way to circumvent family base immigration. Many peoples parents have greencards, brothers, sisters, friends, etc; and they realize that it takes too long to get greencard through family base and the fastest way is to come through h-1b and go through EB route. Also; companies; company owners will favor their own people in filing h-1b's and greencards and then you have a situation where certain people are favored due to their nationality or connection. I firmly believe that uscis and the regulatory authorities understand this and hence the reason why there is country quotas.

There is no such thing in the Indian Constitution as the "national language." You can either read the document yourself or you can refer to the recent (late June 2010) judgment by the Gujarat High Court to this effect.

This is a good first step in this direction after our campaign for FOIA last year. If we can get the data we need, prediction on date movement and getting the clear picture on pending applications should be easy.
I personally feel 5K is too much to charge, but if this is what it takes I think we should pursue it. Lobbying for it may have cost more. We need to get more information about this and if everyone agrees we can raise funds and pay for one request to take it forward.

My MTR has been approved after 70 days and I-485 has been reopened. Though online status has not been changed yet but attorney received an MTR approval notices.

As I mentioned earlier, it is a simple RFE. In addition, Desi has backedup his suggestion with the proof - Just ask your attorney to respond to the RFE. Post back when you get updates, it will help IV community, who are in similar situation and also the members who do not have a proper understanding of statuses.:D

This is one of my friends case: Please guide him....
"My wife's employer filed for her GC during 2007 August rush for all of us. Her case is in EB3 with Feb 2005 PD. My labor is approved and filed for I-140 about a year ago and still hasn't been approved. Now, my PD is current based on yesterday's Visa Bulletin. Can I file another I-485 for me with a pending I-485 thru my wife's employer?"

They did it for their country and fellowmen to be free from the clutches of oppression (a much serious issue than green card i think). Although even that is extended selfishness (cos of being Indian or African American) but they dedicated their entire lives for that cause.

They are worse.. they do not respond quickly, never let you talk to attorneys directly.. have to go through the secretaries and to top all this they mess up the applications.. in short they suck!
I think, many of us go to Murthy.com for the news and latest updates at no cost. This is the best service this firm is providing to the community. I believe, it is most reliable and up-to-date info center (I have my attorney in CA but during last 4 weeks I got answers to my questions from Murthy.com only!).
Whether it is Sheela Murthy or para-legal assistance, it should not matter as long as a right response to a question is given unless someone is looking for a doctor not an attorney in Murthy.com firm.
Let us hear what other thinks.

I am assuming that EB2 India will have a cut-off date of atleast June 2006 for Aug as well as Sep. The time window of approvals is Aug 1 2008 to Sep 30 2008. In this time frame, they will have to pull the files from shelves and make them ready for adjudication.
I also remember from I-485 field SOP, that first step is to contact US Consulate abroad where you filled your DS-156 if you traveled within last 12 months for any discrepancy. This step itself can take a long time.
Then there are a lot of people who had PD current but they haven't done finger-printing yet. Imagine time required to schedule fingerprints, appear for one, and then get the results.
Just my thoughts.

I have been thinking about whether to attend the rally or not from past few weeks. Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!
I am feeling so good now.
Also, I live in DC area and can help if somebody needs to be picked from airport to the rally and drop them back if needed.
Hope to see thousands on 9/18th...

Dear All,
My brother completed his Masters in Mechanical Engg in December 2006 and is on OPT till December 2007.
His H1b was filed through a IT consulting firm (Lets say Company B) and is in process and is due by October.
He has now pursued employment in his own field in company B on his OPT.
Company A is cooperative and says they can assist in h1b transfer when the h1b comes through to company B.
The question is, is paystub needed for this kind of transfer? Or Transfer can be done prior H1b start date (ie Oct 1st, 2007) as he is still in OPT?

I am not negating anyone's personal decision here but after leaving for 10 yrs in US and still not having a GC makes me wonder why I should go to canada rather I would go to india and live there where we spent our 25 yrs or so and be part of the community etc.
