I think there is a bipartisan support for the schedule A visa recapture and moreover its a nations documented shortage professions. I think this recapture of nurse visas is imminent no matter what we do.I think our focus should be undiluted towards the CIR, and it should not divert our focus from that. Opposing the nurse shortage would in fact show is in a poor light and we should make an reasonable yet a firm approach towards a long term approach to the issue.There is allready a talk to completely exempt nurses from the visa cap, and i hence feel our opposition would appear irrational. Really appreciate what IV been doing, there is no quick fix to the problem, the goal should be approached systematically and persistently.

I got a RFE on my 485 on 11th April and I have responded to it. By next week it would be 60 days by which USCIS has to take some decision. What would be the status update as my PD is Aug 2006.
Is it normal to get RFE while PD is not current?

excuse my unfamiliarity with the process..
but if I applied for I485 in July, and 485 applications they receive exceeds the visa numbers available for July, what happens? Do they draw lottery to see which 485 apps would be cosidered?
in other words, just making sure the app reaches USCIS in july first wekk, does it guarantee EAD for spouses?
I have the same question - Do dependent spouses get EAD even if dates retrogress after applying for I-485?

I feel sorry for you. I sincerely request admins to reinstate you here.
Hi all, this is the new ID of bigtime007. As many has noticed, I was banned for the following reason:
You have been banned for the following reason:
Disruptive posts
Date the ban will be lifted: Never
After thinking about it, I feel very very sorry for disrupting the cheerful atmosphere on this forum. It is time for champagne, not complaints. This should be a place to congratulate and applaud IV's achievements, instead of that to express one's own frustrations. People with 07 PD has the privilege to cheer when they cut in front of us, but we should not feel sad for being pushed back because it is a disruptive behavior.
Please do not list what you have done to add items in the legislation to help BEC victims, it does not look genuine any more when it is considered disruptive to express one's depression on a board specially for BEC victims.
This will be my last post, as I am sure they will ban both my ID and IP. For everyone who still reads my post, Good luck!

We have to come up with a request letter addressing to DHS secretary and I am pretty sure It can be done as part of admin fix.
It will bring lot of relief for most of the people whose PD's are after May/June 2007..
I know that its already on IV agenda, but looking at the complexity involved for H1 extensions/transfers/layoffs (especially these days) we cannot wait any longer. I would suggest keeping this particular request separate and especially people who have PD's after May/June 2007 should participate actively.
we can come up with a draft letter addressing to DHS secretary and list out clearly how this would bring a great relief for us.
PAPPU/MIRAGE/VDLRAO other senior member please provide your suggestions. Please help us join in the main stream (wait after applying for AOS :)
Thanks a lot.
Kiran
This is different from what was done in July 2007. Back then all PD was current. This is to grant the ability to file AOS even when the PD is NOT current

hi mirage,
you dont need to pay anymore money for EAD when you apply in future. this is what my attorney said. Thats why USCIS fees is very high and its one time fess for EAD and AP.
Actually you are partly right. Only those who had paid the revised higher fee last year are eligible to get renewals for free. All those who had paid the regular fee (July filers) pay for renewal everytime

People with EB3-India may not expect any kind of fast movement in near future, unless law changes. It will be in snail phase. It is waste discussion to analyze howmany people filled EB3 LC from India in 2002,2003 etc. Generally EB3 is very high demand catagory from all accross the world. EB3 contains skilled worker catagory including cooks, nurses, and so many many non-professional occupations. All the discusion are focussed on demand by Indian IT folks, by ignoring other spectrum of the demand by other group of peoples. Therfore no matter what; EB3-India will get only 3000 EB3 GC per year (Approxmatly 1500 primary).
1500 LC per year EB3 India is a tiny fraction of the demand by EB3 India. Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
Only when EB3 ROW becomes C can EB3 China, India & mexico see a leap in priority dates. March bulletin 08 pushed EB3 ROW by 2 years. Apr bulletin pushed it by another 6 months to Jul05. If demand for EB3 ROW is still low, then final quarter of this fiscal year (Jul to Sep), priority dates for India EB3 can possibly see a jump forward by 1-2 yrs.

AGAIN.......
Why people in the forum still asking people to convert from EB-3 to EB-2?
This is not the SOLUTION!! It will only make things worser and worse...
If people keep converting their EB-3 to EB-2 then what about those EB-3 filers that file their application in earlier years? they will keep stucking in the line forever! THAT's not FAIR!
It is not the time to blame EB-2 or USCIS! IT is the time to dicuss an effective way to to distribute the visa no. effectively.
DO SOMETHING CONSTRCUCTIVE! NOT ONLY FOR YOURSELF! BUT FOR ALL THE VISA/ GC APPLICANTS!

I bet they have only issued around 120,000 EB visas in the year 2006 (Oct 2005 - Sept 2006), even though the quota is around 250,000. (140,000 direct + 100,000 from family other category).
TheLPR flow for EB was 159,081 in 2006.
Employment Preference Limit
The annual limit is equal to 140,000 plus unused FS preferences in the previous FY. There were 3,949 unused FS preferences in 2005. The 2006 EB limit was 143,949 (140,000 plus 3,949). The REAL ID Act of 2005 recaptured 50,000 unused EB visas, 5,125 of which were used in 2005. In 2006, 33,341 of these visas were used, exceeding the 2006 limit.

Dude...read your post properly...u are making a statement...u r not saying it is what USCIS thinks...
And nobody is insecure over here..it's just people like u who have made this forum a place of hatred between people of different countries....
Didn't u learn on day 1 of ur job?...read a few times before u post/mail to anyone....u have no right to use words EB3 and unskilled together...
If u think USCIS thinks that way....pls mention it so...Get a life
FYI...I AM INDIAN
OOOPs you are an Indian.... and how does that affect this discussion?
My mistake .... I thought you were a normal person discussing immigration related matters on an immigration forum and hence have the ability to discern, understand and have some background on immigration law, USCIS

Members, it will be a big help if we just follow the small steps IV has outlined. Big ideas are great but lets start with the easy things first.
December Visa bulletin is obviously frustrating for all of us. After the recent accomplishments in July visa bulletin and the tons of approvals that we saw after that, we hoped that everything will be alright.
But that did not happen. Some of us in the community were taken by surprise, but this was expected. Afterall there are only 140K greencards available every year. EB2 for India and China is already used up for the quarter. EB3 is badly retrogressed for everyone.
Believe me, it will not get any better. It will get worse with time if there is no immigration reform.
IV can only do what its members empower it to do. If members want us to be just a site for question and answers for individual visa problems we can stay like that. If members want us to come together and do a rally in DC, we will help organize it. We did a rally in DC on Sept 18 and made great progress. However we cannot just sit back and admire one effort. We need to continue it and capitalize on it.
Now is the time for everyone to decide if they want a greencard. If you need a greencard, and want to do something about it, then you must join this effort and help yourself by helping everyone.
Our Plans
Our next hope is year end bills. If we can get some provisions in those bills we can certainly look forward to a happy new year with fast movement of visa dates. Next year is an election year and it will become much tougher for any immigration bill to pass. We will need to make super extra push next year for something to happen. So the time to act is NOW.
We have achieved great successes when we all came together and did something. If you need proof read Macaca’s post with compilation of our achievements. http://immigrationvoice.org/forum/showpost.php?p=181953&postcount=216
IV only asks 3 things from each one of you. Having these 3 pillars of support from members we will be able to increase our chances for an year end push.
================================================== ===============================
1) Please sign up for monthly contributions. Monthly contributions help us plan ahead of time and commit our resources. Your participation will determine how big of a push we can afford. Just $50 every month per person can have significant effect on the overall push that IV can plan so please consider contributing.. http://immigrationvoice.org/index.php?option=com_content&task=view&id=26&Itemid=44
Please post on this thread, if you have signed up for monthly contributions.
================================================== ===============================
2) Join your state chapters now. Get together with your fellow community members and meet your local lawmakers. We are a grassroots effort and can be successful if each one of us makes a sincere effort to meet our lawmakers and apprise them of our issues. http://immigrationvoice.org/index.php?option=com_content&task=view&id=72&Itemid=52
================================================== ===============================
3) Consider yourself part of something big. What we are doing is something big. We have already done what was difficult to think when this organization was started. Today we have become a big force and a voice of legal high skilled community. Each one of you defines what IV is. Your posts, your talks with media, your talks with your friends about IV, your talks with your employer about immigration problems, your time and effort you put in for IV defines who we are. Each one of you is important for the success of this effort. Each one of us is a voice and we have converged our energies to make a strong voice. Please consider yourself an integral part of IV and actively participate in the effort.
================================================== ===============================
Let us start a massive effort in this direction and make a year end push!

Doesn't it sound rude... they celebrate, feast and we fast. If we admire this country for giving us so much we should also show our support and adopt the culture and celebrate with them to show we are tax paying Americans who enjoy in American way.
We can show our protest by sending 1-wish for our own GC ( may be in the form of Christmas tree ornament) to all law makers. Everybody makes a wish and our wish is GC.
IMO, it is not rude but definitely brings out the irony of our positions.
